6. How to Secure a Release on Bail or Suspend Detention without Bail (Trusted Delivery)

- If a defendant is approved to be released on bail the bailiff will write a notice for payment. A relative of the defendant should present the notice to the service center; counter two, for the issuing of a duplicate pay slip. With the pay slip, the relative of the defendant can go to counter one to pay. The release is made upon sight of receipt.
- Complete the bailing procedure:
- The defendant or a relative may complete the procedure.
- A relative may be informed by telephone, in writing or by other methods to come to the bailiff and complete the formalities.
- Types of bail:
- Bailed by individual.
- Find a person of integrity who resides in the office's jurisdiction and
has a qualified occupation to serve as guarantor. - Fill out a guarantee form.
- Sign or affix the personal seal or the fingerprint.
- Present the ID for verification.
- Present property ownership certificate.
- Bailed with cash:
- The defendant or the guarantor may pay the designated amount in cash or valued security (calculated on the basis of current value).
- No guarantee paper is required.
- Pay guarantied cash. After office hours the office will assign someone to collect the money for delivery to the national treasury the next day.
- Trusted delivery of the released defendant:
- The defendant must be delivered to his or her assistant, a proxy designated by the assistant, the senior relatives of the defendant or a person with decent occupation residing in the jurisdiction of the office.
- The designated person shall present his or her ID for verification, fill out a delivery form and affix a personal seal or fingerprint.
- The defendant will be released upon the completion of the delivery procedure.
- If a defendant who has a prosecutor's approval for release on bail can not complete the procedure on that day he or she may petition the court for the release on bail.
- The police will not collect any fee for processing, checking, and verifying the bail or for delivering the defendant.
- Time limit for the process: A case is processed when it comes.
